Miller Reintroduces Saving Gig Economy Taxpayers Act

March 5, 2025

Washington, D.C. – Today, Congresswoman Carol Miller (R-WV) reintroduced the Saving Gig Economy Taxpayers Act to restore the 1099-K threshold level of $600 back to the original $20,000 and 200 transactions by repealing the Democrats’ American Rescue Plan policy, which has placed an unfair tax hike upon Americans and gig workers. Congresswoman Miller is introducing this bill with 24 of her Ways and Means Republican colleagues as original co-leads.

"For the last four years, Americans have been uncertain about how much they owe in taxes because of the Democrats’ unnecessary changes to the 1099-K threshold. I’m reintroducing the Saving Gig Economy Taxpayers Act to protect Americans who use online payment platforms, gig economy workers, and small e-commerce sellers to ensure they have access to reliable income streams,” said Congresswoman Miller. “Because Democrats’ lowered the 1099-K threshold, an American selling old exercise equipment from his garage online now qualifies as a salesman of workout equipment, a teenager babysitting the neighbors’ kids has a childcare business, and roommates who split rent are now property managers — and all of them will be receiving 1099-K forms from the IRS. The Republican led House will restore the 1099-K threshold to the time-tested amount of $20,000 and 200 transactions."

“With the start of the 119th Congress, the Coalition once again expresses our gratitude to Representative Carol Miller for her unwavering leadership on the Saving Gig Economy Taxpayers Act,” said the Coalition for 1099-K Fairness. “We are eager to build on the momentum from last fall and deeply appreciate her efforts to ensure that Congress provides permanent relief to millions of casual sellers, start-ups, and small businesses who sell used or pre-owned goods or transact on online platforms. This bill will help ensure that Americans will not be unnecessarily burdened with tax forms for splitting meals, selling used goods, paying back a friend, or other instances where no taxable income was generated. In light of the growing number of Americans receiving 1099-Ks this year, we are grateful for Representative Miller and the support of all the cosponsors from the Ways and Means Committee who are supporting this legislation and we encourage all Members of Congress to strive to permanently fix the 1099-K process in 2025.”

“The Saving Gig Economy Taxpayers Act represents a significant step towards alleviating the unnecessary burden on Cash App’s microentrepreneurs,” said Amanda Anderson, Block Inc’s Global Head of Public Policy and Government Relations. “We applaud Congresswoman Miller for her leadership on this critical issue, and we urge Congress to act swiftly to protect the interests of small businesses nationwide.”

“Etsy is supportive of congressional efforts that permanently increase the minimum tax reporting threshold for 1099-K forms. The current $600 threshold imposes unnecessary burdens on casual sellers and micro businesses, who now must navigate complicated reporting requirements. This could unintentionally create significant barriers to entry for eCommerce for American small and micro sellers,” said Jeffrey Zubricki, Etsy's Global Head of Advocacy and Public Policy.

“The Saving Gig Economy Taxpayers Act will help millions of Americans who turn to platforms like eBay to sell used goods around their house," said Ashley Shillingsburg, Head of Americas Government Relations for eBay." Congresswoman Miller has been a steadfast champion in working to ensure Americans don't have non-taxable income reported to the IRS.”
